This website is operated by ENGLISH EXPERTS in Australia and is intended for use by Australian residents only. ENGLISH EXPERTS offers online services focused on essay marking and educational support for Year 11 and 12 students.

By accessing this site or using our services, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Site.

1. Definitions

In these Terms, the following definitions apply:

- "Site" refers to the website operated by ENGLISH EXPERTS located at englishexperts.com.au including all associated content, features, and services.
- “Us” or “Our” refers to ENGLISH EXPERTS as an entity and any representatives or employees of ENGLISH EXPERTS.
- "User” or “Users", "you", or "your" refers to any individual or entity who accesses or uses the Site.
- “Service” or “Services” refers to any features, functionalities, tools, resources, or offerings provided by ENGLISH EXPERTS through the Site, or sent to users via email by a representative or employee of ENGLISH EXPERTS, whether free or paid.
- "Content" refers to all text, images, video, audio, graphics, software, data, and other materials available on or through the Site, whether created by us or sent to you. By submitting content, you grant ENGLISH EXPERTS a non-exclusive, royalty-free, and revocable licence to use your submitted materials solely for the purposes of providing feedback and improving service quality. You retain ownership of your work.
- "User Content" means any content, materials, or information that a user submits, uploads, posts, or otherwise provides through the Site.
- "Third-Party Websites" means any websites or services not owned or controlled by ENGLISH EXPERTS that may be linked to or referenced on the Site.
- "Terms" refers to these Terms and Conditions, including any updates, modifications, supplements we may post from time to time.

2. Use of Site and Services

These Terms form a legally binding agreement between you and ENGLISH EXPERTS. Users under 18 must have parent or guardian consent to use the Site. By continuing to use the Site, you represent and warrant that you have obtained such consent, and that your parent or guardian has read and agreed to these Terms on your behalf. If you are a parent or guardian permitting a minor to use the Site, you agree to be bound by these Terms and responsible for their use. If you are under 18 and access or use the Site without such consent, you are in breach of these Terms and your access is unauthorized. This consent is documented electronically through a checkbox or digital declaration that confirms the parent/guardian understands and agrees to the site’s Terms and Conditions and Privacy Policy. The consent record, including the consenting adult’s name, email, IP address, and time/date of submission, is securely stored in our system for audit and compliance purposes.

We retain consent records and related personal information for a period of 7 years, unless otherwise required by law or requested for deletion by the authorised user. You accept these Terms by accessing, browsing, or otherwise using the Site or any of the services we offer (collectively, the “Services”). By using the Site and/ or services, you confirm that any submission is your own original work. We recommend that you save or print a copy of these Terms for your records.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site and its content for your personal, non-commercial, educational use, subject to these Terms. This includes viewing and downloading a single copy of essay questions, edited feedback documents, exemplars, and other resources (“Materials”), provided you do not alter or remove any copyright or proprietary notices.

Users must not:

- Share, distribute, reproduce, modify, or sublicense the Materials;
- Use the Site or Materials for commercial gain without written permission;
- Disclose or transmit Materials to third parties;
- Reverse engineer, decompile, or attempt to extract source code from the Site.
- Any breach of these Terms will result in immediate termination of your access to the Site.

3. User Representations and Warranties

You agree not to use any automated system to access the Site for competitive or commercial monitoring purposes without our express written consent.

By using the Site, you warrant that:

- You are not acting on behalf of a competing education or test preparation provider;
- You are using the Site and Materials solely for the purpose of your personal academic development;
- All information you provide is truthful and accurate.
- You will not misuse the Services to circumvent academic integrity policies.

4. Academic Integrity

You must not use Services to engage in plagiarism or academic misconduct. Essay feedback is for personal development and should not be submitted as-is to any institution.

5. Intellectual Property

All content is owned by ENGLISH EXPERTS or its licensors and is protected under Australian law.

You may not:

- Claim ownership over any Site content
- Reuse Materials without written permission
- Use our trademarks without consent
- Redistribute or publish the Materials without express written permission

6. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Privacy Act 1988 (Cth): https://englishexperts.com.au/privacy-policy.

We collect and store data in accordance with the Privacy Act 1988 (Cth), including relevant general information about the school the student is attending, the year level and the postcode associated. We do not collect any identifiable information about the student (such as the name, date of birth, etc.).

7. No Warranty

To the extent permitted by law, including the Australian Consumer Law, the Site and Materials are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Site will be free from errors, viruses, or interruptions.

Nothing in these Terms excludes or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable laws that cannot be excluded or limited.

8. Refund/ Cancellations

If you are a consumer under the Australian Consumer Law, you are entitled to a refund, replacement, or resupply where services are not provided with due care and skill, are not fit for purpose, or do not match their description. We do not offer refunds for change of mind unless otherwise stated in writing.

- Include your name, transaction ID/ Receipt Number, and reason for request.
- We will then respond within 5 business days.

9. Limitation of Liability

To the maximum extent permitted by law:

- ENGLISH EXPERTS is not liable for any loss or damage arising from your use of or reliance on the Site or Services;
- Our liability for any breach of a condition or warranty under the Australian Consumer Law is limited, at our discretion, to resupplying the relevant service or refunding the cost paid for it;
- We are not liable for indirect, incidental, punitive, or consequential losses.

10. Dispute Resolution

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia in relation to any dispute arising from your use of the Site.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Site. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.
